342 A motorcycle rider causing death under the influence of drugs, hallucinogens, narcotics, and similar official controlled drugs or alcohol shall be sentenced to fixed-term imprisonment of no less than 3 years but no more than 10 years, and may also be fined no more than NT$2 million. Should said offense result in serious injury, the person will be sentenced to fixed-term imprisonment of no less than one year but no more than seven years, and a fine of no more than NT$1 million may be imposed in addition.
