⑴黃非泓為台北市某國中三年級之男性應屆畢業生。於申請免試入學選填志願時，擬將「台北市立第一女子高級中學」 （以下稱北一女中）列為第一志願。但依基北區高級中等學校免試入學委員會之相關規定，男性學生不得將北一女中列為入學志願。且北一女中招生名額中亦無男生。黃非泓遂無法將北一女中列於志願表。黃非泓認為北一女中僅招收女生，而不招收程度相當的男生，為「因性別而為之 差別規定」，違反憲法第 7 條之平等權規定。但教育主管機關則以性別平等教育法第 13 條作為抗辯。黃非泓經法定爭訟程序確定後，聲請司法院大法官解釋，請求大法官將「北一女中僅招收女生」之規定以及性別平等教育法第 13 條之規定宣告違憲。 教育部決定為「北一女中僅招收女生」與性別平等教育法第 13 條之合憲性辯護。而您是教育部在本件爭議之訴訟代理人。請撰寫一份法律分析意見書，引用相關憲法條文、大法官解釋，以及學理論述，就正反雙方意見加以探究，並提出支持教育部見解之結論。
